İşbu Mesafeli Satış Sözleşmesi (“Sözleşme”), aşağıda bilgileri bulunan taraflar arasında, aşağıda belirtilen hüküm ve şartlar çerçevesinde kurulmuştur.

ALICI, işbu Sözleşme’yi kabul etmekle; sipariş verdiği takdirde sipariş bedeli, vergiler ve varsa ek masrafları ödeme yükümlülüğü altına girdiğini kabul, beyan ve taahhüt eder.

SÖZLEŞMENİN KONUSU

İşbu Sözleşme’nin konusu; ALICI’nın, SATICI’ya ait www.turkeymarineservice.com internet sitesi üzerinden elektronik ortamda sipariş verdiği, nitelikleri ve satış bedeli sitede belirtilen ürün ve/veya hizmetlerin satışı ve teslimi ile ilgili olarak, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği kapsamında tarafların hak ve yükümlülüklerinin belirlenmesidir.

SÖZLEŞME KONUSU ÜRÜN / HİZMET VE SATIŞ BEDELİ

Sözleşme konusu ürün veya hizmetin türü, miktarı, temel nitelikleri, satış bedeli, ödeme şekli ve teslimat bilgileri; www.turkeymarineservice.com internet sitesinde yer alan ürün sayfasında ve düzenlenen faturada belirtilmiştir.

Sitede yer alan fiyatlar ilan tarihinden itibaren geçerli olup, SATICI tarafından güncellenene kadar bağlayıcıdır. Kampanyalı fiyatlar yalnızca belirtilen süre boyunca geçerlidir.

ÖDEME ŞEKLİ

Ödemeler, altyapısı iyzico Ödeme ve Elektronik Para Hizmetleri A.Ş. tarafından sağlanan online ödeme sistemi üzerinden kredi kartı ile yapılır.

ALICI, ödeme sırasında kullandığı kredi kartına ilişkin bilgilerin doğruluğundan sorumludur. Kredi kartı bilgileri SATICI tarafından kaydedilmez ve saklanmaz.

Taksitli ödemelerde faiz, vade farkı ve ödeme planı tamamen ALICI ile banka arasındaki sözleşmeye tabidir. Bu hususlarda SATICI’nın herhangi bir sorumluluğu bulunmaz.

TESLİMAT

Fiziki Ürünler

Fiziki ürünler, ALICI’nın sipariş sırasında bildirdiği adrese, anlaşmalı kargo firması aracılığıyla gönderilir. Kargo firması ürünü teslim aldığı anda risk ALICI’ya geçer.

Dijital Ürün / Hizmetler

Dijital içerik, yazılım, doküman veya online hizmetler, ödeme tamamlandığı anda elektronik ortamda teslim edilmiş sayılır.

İnternet altyapısından kaynaklanan kesinti ve erişim sorunlarından SATICI sorumlu değildir.

GENEL HÜKÜMLER

  • ALICI, internet sitesinde yer alan ön bilgilendirme metnini okuyup anladığını kabul eder.

  • ALICI, siteyi hukuka, ahlaka ve sözleşme hükümlerine aykırı şekilde kullanamaz.

  • Satın alınan ürün/hizmet üçüncü kişilere devredilemez, kiralanamaz, çoğaltılamaz.

  • Ürün ve hizmetlere ait tüm fikri ve sınai haklar SATICI’ya aittir.

  • Aynı hesapla birden fazla IP üzerinden yetkisiz kullanım tespit edilirse erişim iptal edilir ve ücret iadesi yapılmaz.

CAYMA HAKKI

6502 sayılı Kanun gereği;

  • Anında ifa edilen dijital içerikler,

  • Elektronik ortamda teslim edilen hizmetler

için cayma hakkı bulunmamaktadır.

Fiziki ürünlerde cayma hakkı, ürünün tesliminden itibaren 14 gün içinde kullanılabilir. Cayma hakkının kullanılması için ürünün kullanılmamış ve yeniden satılabilir durumda olması gerekir.

İADE

Cayma hakkının geçerli olduğu durumlarda iade, yalnızca ödeme yapılan kredi kartına yapılır. Nakit iade yapılmaz. İade süresi bankaya bağlı olarak değişebilir.

MÜCBİR SEBEPLER

Doğal afet, savaş, pandemi, grev, enerji kesintisi, resmi makam kararları gibi SATICI’nın kontrolü dışındaki haller mücbir sebep sayılır. Bu durumlarda SATICI’nın sorumluluğu doğmaz.

YETKİLİ MAHKEME

İşbu Sözleşme’den doğacak uyuşmazlıklarda Türk Hukuku uygulanır.
Tüketici işlemlerinde; ALICI’nın yerleşim yerindeki Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri yetkilidir.

YÜRÜRLÜK

ALICI, internet sitesi üzerinden sipariş verip ödemeyi tamamladığı anda işbu Sözleşme’yi tüm hükümleriyle kabul etmiş sayılır. Sözleşme bu tarihte yürürlüğe girer.

By accepting this Agreement, the BUYER acknowledges and agrees that upon confirming the order, they shall be obliged to pay the order amount together with any applicable taxes and additional charges.

SUBJECT OF THE AGREEMENT

The subject of this Agreement is the determination of the rights and obligations of the Parties regarding the sale and delivery of the product(s) and/or service(s) ordered electronically by the BUYER via the website www.turkeymarineservice.com, in accordance with Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

PRODUCT / SERVICE INFORMATION AND PRICE

The type, quantity, basic characteristics, sales price, payment method and delivery details of the product(s) and/or service(s) subject to this Agreement are specified on the relevant product page of www.turkeymarineservice.com and on the invoice.

Prices published on the website are valid until updated by the SELLER. Campaign prices are valid only during the announced campaign period.

PAYMENT METHOD

Payments are made by credit card via the online payment infrastructure provided by iyzico Payment and Electronic Money Services Inc.

The BUYER is responsible for the accuracy of the credit card information provided. Credit card details are not stored or recorded by the SELLER.

Any installment options, interest rates, maturity differences or late payment charges are subject solely to the agreement between the BUYER and the issuing bank. The SELLER bears no responsibility in this regard.

DELIVERY

Physical Products

Physical products shall be delivered to the address specified by the BUYER via the contracted cargo company. Risk transfers to the BUYER once the product is delivered to the cargo company.

Digital Products / Services

Digital content, software, documents or online services are deemed delivered at the moment payment is successfully completed.

The SELLER shall not be held responsible for internet access interruptions or technical issues beyond its control.

GENERAL PROVISIONS

  • The BUYER declares that they have read and understood the preliminary information provided on the website.

  • The BUYER shall not use the website in violation of applicable laws, public order or this Agreement.

  • Purchased products or services may not be transferred, resold, rented or shared with third parties.

  • All intellectual and industrial property rights related to the products, services and website content belong exclusively to the SELLER.

  • If unauthorized access from multiple IP addresses is detected, access may be terminated without refund.

RIGHT OF WITHDRAWAL

Pursuant to Law No. 6502:

  • Services performed instantly in electronic environment,

  • Digital content delivered instantly to the consumer

are excluded from the right of withdrawal.

For physical products, the BUYER may exercise the right of withdrawal within 14 (fourteen) days from the delivery date, provided that the product is unused and resalable.

REFUNDS

Where withdrawal is valid, refunds shall be made only to the credit card used for payment. Cash refunds are not possible. The completion time of refunds depends on the bank’s procedures.

FORCE MAJEURE

Events such as natural disasters, war, pandemics, strikes, power or communication outages, or official authority decisions beyond the SELLER’s control shall be considered force majeure. In such cases, the SELLER shall not be liable for non-performance or delay.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey.

For disputes within the monetary limits announced annually by the Turkish Ministry of Trade, Consumer Arbitration Committees shall be competent. For disputes exceeding such limits, Consumer Courts at the BUYER’s place of residence shall have jurisdiction.

EFFECTIVE DATE

This Agreement shall enter into force upon the BUYER’s electronic confirmation and successful completion of payment via the website. The BUYER shall be deemed to have accepted all terms and conditions of this Agreement.
